By purchasing an illustration, service or product from Jade Amalos Illustrations ("Jade", "I", "me", "my"), you ("you", "the client") agree to the terms below. Please read them before you buy, they're here to keep things clear and lovely for both of us.

1. My work

Everything I create is custom, hand-drawn and digital in nature. Each piece is made to order for you, based on the brief, photos and information you provide. Because the work is bespoke and delivered digitally, please choose carefully before purchasing.

2. Pricing & payment

  • All prices are in Australian Dollars (AUD).

  • Payment is taken at checkout, either in full, or via the payment plan where offered (a 25% deposit followed by 4 weekly instalments).

  • On a payment plan, work begins after the deposit is received. Final files are only released once the full amount has been paid.

  • If an instalment fails or isn't paid on time, I'll pause your project and reach out. Ongoing missed payments may result in the project being closed (see clause 4).

3. Refunds & cancellations

Because my work is custom-made and digital, I do not offer refunds for change of mind once a purchase is made or work has begun. Deposits are non-refundable once I've started your project, as your slot and time have been reserved.

This does not affect your rights under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee that cannot legally be excluded. If something genuinely goes wrong on my end, please contact me and we'll make it right.

4. What I need from you (and the 90-day window)

To complete your illustration I'll need things from you, usually clear photos, a brief, or answers to a few questions. Your project can only move forward once I have these.

  • After you purchase, I will attempt to contact you up to three (3) times to collect what I need.

  • If I don't hear back from you, or don't receive the materials I need, within 90 days of purchase, your project will be considered abandoned and closed, and payment will be forfeited with no refund or credit.

  • If life gets in the way, just let me know, I'm happy to work something out if we're in touch.

5. Turnaround & timeframes

Any timeframes I give are estimates, not guarantees. Turnaround depends on my current workload and on how quickly you get me what I need. Delays caused by late materials, slow responses or expanded scope will push your timeline out.

6. Revisions & changes

  • The Hand-Drawn Hero and Storefront Illustration include two (2) rounds of tweaks.

  • Revisions are for refining the agreed piece, not for changing direction or brief after work has started.

  • Additional revisions, or new requests beyond the original scope, are charged at my hourly rate of $110/hr, quoted before I begin.

7. Approval & delivery

  • Files are delivered digitally (print and web-ready formats as described in each offer).

  • Once you approve the final artwork, the project is complete. Any changes requested after final approval are treated as new work and charged accordingly.

  • Please download and save your files promptly. [Optional: I keep files for X months after delivery but can't guarantee access beyond that.]

8. Copyright & usage

  • I retain copyright and ownership of all artwork I create, including drafts and concepts.

  • On full payment, you receive a full commercial licence to use your finished illustration however your brand needs it, on packaging, products, socials, your website, marketing, signage and so on.

  • You may not resell, sub-license, or distribute the artwork as a standalone product, or claim you created it, or pass it to another artist to alter.

  • A credit or tag (@jadeamalosillustrations) is always appreciated but never required.

9. Your rights to what I'm drawing

By commissioning me, you confirm that you own or have permission to use the products, brand, logos, photos or property you're asking me to illustrate. You agree to cover me against any claim arising from artwork made based on materials or instructions you provided.

10. Portfolio & promotion

  • I may display finished work in my portfolio (website, and to show prospective clients) as an example of my work.

  • I will only promote your work on social media once you've given consent.

  • If your brand or product is unreleased and you need it kept private, just let me know and I'll hold off sharing anywhere until you say it's live.

11. The nature of hand-drawn work

My illustrations are my own hand-drawn interpretation in my style, they're artwork, not exact photographic copies. For Product Illustrations, the result depends on the quality of the photo you provide, so the clearer the photo, the better the outcome.

12. Liability

To the extent permitted by law, my liability for any claim relating to my work is limited to the amount you paid for that work. I'm not liable for any indirect or consequential loss.

13. Chargebacks

Please talk to me first if there's ever an issue, I'm genuinely easy to deal with. Raising a chargeback or dispute without contacting me, on work that has been delivered or is in progress, is a breach of these terms.

14. Changes to these terms

I may update these terms from time to time. The version in place at the time of your purchase applies to your order.

15. Governing law

These terms are governed by the laws of Queensland, Australia.
